Undisclosed Defects in Recent Home Purchase
Despite the best of intentions, sometimes we buy a home and find out too late it has unknown problems, sometimes very significant problems. In Oklahoma, the Oklahoma Real Property Condition Disclosure Act requires all sellers to disclose all defects known by the seller or the seller’s agents. The RPCDA additionally requires all sellers to disclose repairs made to certain items on the property. All of these requirements exists whether a buyer knows or was told of the requirement. All too often a seller thinks they do not have to disclose things, or worse, is told by their real estate agent that they are not required to provide the disclosure statement at all.
